Don Padou '11 to File Suit Against D.C. Water and Sewer Authority

Don Padou '11 plans on filing suit at the end of August on behalf of some residents of Bloomingdale who have suffered flooding caused by sewage backing up out of the District of Columbia Water and Sewer Authority’s (WASA) pipes. Right now WASA’s pipes are not big enough to handle both sewage and run-off and reach capacity when there is a moderate storm.The sewage/run-off mix is going into people’s homes through toilets, bathtubs and floor drains.Residents have anything from several to 17 inches of sewage flood their homes, with many people having been flooded three times this summer.

WASA is aware of the problem and proposes a series of giant tunnels to carry the sewage away for treatment, with the project to be completed by approximately 2025.Meanwhile, WASA says that it is not responsible and will not offer compensation for the damage caused by the sewage flooding.Don Padou’s clients believe that WASA is legally responsible and have come to believe that only by going to court that they can receive compensation.
