Congrats to Professor Ed Allen and the students of the UDC
David A. Clarke School of Law Housing Clinic, whose arguments on procedural
omissions and due process violations were validated by a recent 14 page
decision. As a result of the ruling, the Clinic was able to undo a 31% rent
increase, which has been in effect for a year, in a twenty-five unit, Columbia
Heights building. Total monthly savings per unit is about $250. Total savings
for all units for the year is about $80,000!
According to Clinic Director, Allen, "Once the agency
corrects the due process/procedural transgressions, we expect to win on the
merits based on a nifty but esoteric argument entailing the misrepresentation of
encumbrances on the property. Far as we know, no one has successfully made
these arguments before. The due process argument should extinguish a 70%
increase—at least for a year-- in another building we represent on ninth
